SituationWhat we do
Advertising claimsWe examine advertising and promotion concepts before you launch them, including comparative advertising and statements about product properties that a competitor may challenge as misleading. We help you document the basis for each claim.
Product names and presentationWe assess whether names, colours, origin indications and the overall presentation of a product or website could mislead customers.
Distribution conceptsWe review sales and distribution models for unfair competition risks, including how customers are approached.
Warning letters and complaintsWe draft warning letters to competitors, and we advise and represent you when a competitor complains about your advertising.
Copying and imitationWe assess whether a competitor imitates your products, presentation or branding and choose the route to act against it.
ProceedingsWe represent you before the Competition Protection Commission and the competent courts, including on appeal.

How a claim of unfair competition is assessed

A complaint of unfair competition normally succeeds or fails on a few questions: whether both parties carry on business and compete with each other, whether the conduct is contrary to fair trade practice, and whether it harms or may harm a competitor. For advertising, the key question is whether it can objectively mislead the customers it addresses and influence their economic decisions. Authorities and courts look at the message as a whole and at the average consumer, not at an isolated word or an interpretation the advertiser never intended. Technical evidence, such as expert opinions and certificates for a product, is often decisive. We build the case on these questions from the start, whether you are the complainant or the party complained against.

Unfair competition and trade marks

Imitation of products or branding often involves trade mark rights as well as unfair competition rules. We assess both together. See our page on trade mark law in Bulgaria.
